Chief Justice should constitute a full court bench to interpret Article 63A: Federal Law Minister

Federal Law Minister Nazir Tarar has said that the full court should now hear the interpretation of Article 63A so that the country can be taken out of the current constitutional crisis.

Azam Nazir Tarar, while holding a press conference with Punjab Interior Minister Atta Tarar in Lahore, said that for the past few months, he has gone to the Supreme Court in various cases, one of which is the interpretation of Article 63A, which Imran Khan in the previous government. A reference was sent by the President of Pakistan to the Supreme Court asking the Supreme Court to tell the Government of Pakistan whether under Article 63A, if some members vote outside the direction of their party, whether their vote will be counted or not. .

Azam Nazir Tarar said that when the case was under hearing, it was sought to be exempted and the Supreme Court was repeatedly requested to issue an injunction that if a dissident member casts a vote, that vote should not be counted. But the Supreme Court did not grant immunity and during this period voting was held on the Dissatisfaction Movement in the National Assembly and after that Hamza Shehbaz won by 197 votes for the Chief Minister of Punjab.

Azam Nazir Tarar said that then the matter also went to the Supreme Court that this election was valid or not and then a five-member bench of the court held a hearing, out of which three judges said that if such members who received instructions from the party chief And if they vote against it, then their vote will not be counted and then after this decision, Lahore High Court gave its decision in the light of this decision.

He said that in the election of the Chief Minister in the Punjab Assembly the day before yesterday, the situation came before the Deputy Speaker that the head of Pakistan Muslim League (Q) wrote a letter to the Deputy Speaker in which he wrote that under 63A 10 members were instructed to cast their votes for Hamza Shehbaz and then the Deputy Speaker discarded the votes of those members after which 176 votes were obtained instead of 186 for Pervaiz Elahi while Hamza Shehbaz won with 189 votes.

Azam Tarar said that on the same night Chaudhry Pervez Elahi filed an application in the Lahore Registry of the Supreme Court and the court was opened at night and now the matter is in the court.

He said that all the parties involved in the government coalition unanimously said that it is appropriate that the Supreme Court Bar Association challenged the interpretation order in revision on the votes being cast and not counted and disqualifying the former including the present case. The full bench should consolidate the main cases like interpretation of Article 63A including petitions of the declared members so that the country can be extricated from this constitutional crisis immediately.

He said that there was also a demand from the civil society that there should be a larger bench or full court for cases of political nature and important constitutional nature so that justice can be seen.

Azam Nazir Tarar said that if the representative of 12 crore people has to be sent home by the court decision, then I will definitely understand that the court should listen to the fair and independent demand and now all the political parties and civil society also have the same idea. Is.
